Terms of service

Welcome to BrightSide Store. These Terms of Service (“Terms”) govern your access to and use of our website, storefront, and purchases from BrightSide Store, operated by Bright Light Solutions (“we,” “us,” “our”).

By browsing or placing an order, you agree to these Terms and to our Return and refund policy, Shipping policy, Privacy policy, and any product-specific terms on a listing.

1. Store and products

BrightSide Store sells physical retail goods, customizable / made-to-order products, limited-time or auction-style offers, and may list software or professional services (including offerings associated with Bright Light Solutions). Product descriptions, images, and prices are provided for information; we aim for accuracy but may correct errors.

2. Accounts

If you create a customer account, you are responsible for keeping login credentials confidential and for activity under your account. Notify us promptly of unauthorized use.

3. Orders and payment

• Submitting an order is an offer to buy. We may accept or decline an order (for example due to stock, pricing error, fraud checks, or shipping restrictions).
• Prices are shown in the currency presented at checkout and may exclude duties or import fees unless stated.
• Payment is processed by Shopify and the payment methods we enable. You represent that you are authorized to use the payment method provided.

4. Shipping and risk of loss

Physical goods are shipped under our Shipping policy. Title and risk of loss pass according to the shipping terms of the carrier and applicable law once we hand the package to the carrier, except where mandatory consumer rules require otherwise.

5. Returns and refunds

Returns, cancellations, and refunds are governed by our Return and refund policy. Custom, digital, auction, and service products may have limited or no return rights as described there.

6. Custom and buyer-supplied content

For custom orders, you warrant that specifications, artwork, text, or materials you provide do not infringe others’ rights and are lawful. We may refuse or cancel custom work that appears unlawful, infringing, or unsafe. Custom goods are generally non-returnable once production has started.

7. Digital products and services

Software, downloads, and professional services may be subject to separate license or service terms. Where no separate agreement is provided, delivery of access or commencement of work constitutes acceptance, and refunds are limited as in our Return and refund policy.

8. Intellectual property

Store content—including branding, logos, product photography, copy, and design—is owned by us or our licensors. You may not copy, scrape, or reuse store content for commercial purposes without written permission. Product brand names on third-party goods remain the property of their owners.

9. Acceptable use

You agree not to misuse the store, including by fraudulent orders, payment abuse, interfering with site operation, harvesting data without permission, or violating applicable law.

10. Disclaimer of warranties

To the fullest extent permitted by law, the store and products are provided “as is.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are prohibited (including certain consumer protections that cannot be waived).

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the store or products. Our aggregate liability for any claim relating to an order is limited to the amount you paid for that order, except where liability cannot be limited by law (including liability for death or personal injury caused by negligence, or fraud).

12. Indemnity

You agree to indemnify and hold us harmless from claims arising from your misuse of the store, your breach of these Terms, or content you submit for custom products, except to the extent caused by our own negligence or wilful misconduct.

13. Governing law

These Terms are governed by the laws of British Columbia, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Courts in Vancouver, British Columbia have exclusive jurisdiction, except that consumers may have mandatory rights to bring claims in their home jurisdiction where required by law.

14. Changes

We may update these Terms by posting a revised version on this page. Continued use of the store after changes constitutes acceptance of the updated Terms for future orders. The Terms in effect at checkout apply to that order.
